Battery Monitor Problem

I have just recently installed Mint 9 Isadora (gnome) on my laptop. I am dual booting with windows vista.

My laptop is : Compaq CQ40 131tu

I have a problem with the mint battery monitor. Whenever my laptop COMES OUT OF SLEEP MODE, my battery monitor cannot detect a battery, period, regardless if I'm on AC power or running on battery. I also checked in "system profiler and benchmark" - when I click on the battery, the info says "no battery detected". BUT - when i restart the computer and log on to mint.... the battery and ac power is detected (depending on what I'm running on). Again if I close my lid (or computer sits idle and goes into sleep mode) and then i come back.... battery cannot be detected. I have already tried updating my bios (i did that through vista) but the problem was not solved.

I would appreciate the help.

right click on rhe taskbar and go to "add to panel"

look for the battery panel,
