I was running an Ubuntu rt-kernel under Ubuntu studio and even used a custom made ZEN-kernel.
Ubuntu introduced in 8.10 ( probably even with a patch) a DKMS autoinstaller to get restricted modules such as fglrx automatically installed during boot.
This would be e.g. needed if a different kernel would be installed.
I just installed the Ubuntu rt-kernel. Fglrx won't install on the non-MINT rt-kernel.
I know this is probably not a MINT problem. But maybe there is a solution to it.

The DKMS works the same on the kernels in any distro, not only Ubuntu and Mint so it's a kernel problem

I don't think it is a kernel problem. I had issued a TT at launchpad related to the same ( or perhaps similar issue).
They introduced a patch for it. Ubuntu does an automatic fglrx dkms-install during boot on different (whatsoever) kernels.
I've been running it for quite some time now.
