If I type sudo mintInstall in a console I get:
warnings.warn("apt API not stable yet", FutureWarning)
Traceback (most recent call last):
File "/usr/lib/linuxmint/mintInstall/mintInstall.py", line 426, in <module>
home = sys.argv[3]
IndexError: list index out of range
EDIT: or maybe I have it wrong... is this command only valid for installing from the livecd?

You are only supposed to use mintInstall from the software portal
http://www.linuxmint.com/software/
unless you intend to make a mintfile
