FBI Agents Shut-Down MegaUploads sites

Today, US FBI Agents swarmed into 9 foreign nations as well as here in USA to seize 50 Million dollars worth of servers, IT equipment as well as 18 domestic and offshore domains under the guise of America's file sharing copyright infringement laws. Defendants are now facing 50 years in some US Prison each.

It appears that although many of the purported file sharing servers were overseas (not physically located in USA), there was at least one server of the MegaUpload.com network that was located in Virginia (big mistake). That apparently opened the door for FBI agents to extort 8 foreign nations to comply with US arrest warrants, seizure of 50 million dollars worth of equipment and the seizure of 18 domains. Presumably, the goose stepping FBI agents arrested and (kidnapped) placed those foreigners into custody although it is unlikely the nations where those servers were physically located as well as the existing laws in those nations would even support such expanded global USA policing actions much less expect foreign citizens to be fully conversant with 100's of USA laws including those which a lot of American citizens didn't even know existed.

US Gov. using taxpayer funding to go on a global crusade on behalf of sometimes dubious or hidden file-sharing US laws and forcing them via extortion and threats down the throats of overseas nations leaders onto their citizens is IMO going to backfire badly on America and the American people.

In Closing:

Does Hong Kong, China or Sweden uphold much less support such heavy handed actions by the US FBI? I seriously doubt they do and yet it is apparent the US State Dept. has in the least coerced a great many nations or nations leaders to go along with these jack booted actions fully placing the burden of US laws, corrupt legal system and often obscure US laws squarely onto the backs of Internet users around the world. Remember one of those indicted and now facing 50 years in some US Federal Prison was simply a website graphics designer.

An hour after the indictment was announced, the Justice Department's website, http://www.Justice.gov, came under cyberattack with a denial-of-service attack. Anonymous, the hacktivist computer group, is claiming responsibility.

My open thanks to the outstanding folks of the Linux Team and Community that have poured their support into promoting open source and free OS systems and for the many that have read and viewed my initial posting on this latest US Gov. attack on a cloud storage based server series of websites.

As many are now realising this latest US Gov. raid of cloud storage servers casts a very long shadow over just who owns the information and files that YOU thought you purchased, owned and backed up on a cloud storage server. By first glance it appears the owner of a digital album of music, movie or software has every right in making personal backups to insure against the possible theft, loss or as often the case the collapse of the Windows based OS forcing them to have a backup rather than be forced into repurchasing that same item again.

As related in the US Gov. Dept of Justice (DOJ) reports on MegaUpload, personal users were allegedly providing others with their links to their alleged copyright material. When this was reported to MegaUpload, their staff allegedly deleted the link to that content, however the US Gov. DOJ counters that claim by stating multiple different links to that same content remained. Such is the typical cat and mouse game by the US Gov. DOJ trying to diminish plausible deniability. The biggest problem for the defendants (MegaUpload) in this case imo is that one of the alleged cloud servers was physically located in the State of Virginia former home of the Central Intelligence Agency whom has since relocated to Boulder, Colorado. The open door State laws in Virginia are such that it is going to be difficult at best for the extremely large and talented MegaUpload defense team to secure a successful outcome.

Obviously when the US Gov. internet copyright laws can be twisted by the US DOJ to go after cloud servers that places all cloud server administration including their programmers and even as originally posted even their web designers in distinct danger should the US DOJ decide to summarily go after that service.

(Plausible) deniability definition: The ability to deny an accusation as by claiming to have no knowledge of the actions or events involved.

Future Steps which a cloud based server Internet provider should consider:

1) All users sign a disclosure relating they have read and understand? existing Internet copyright laws. (Although I seriously doubt a 3rd year law student fully knows and 'understands' just the USA Internet copyright laws much less those of 100's of other nations as well.)

2) All files are (1st. or 2nd. party) encrypted which are then transferred to the cloud server to be stored.

A) Why 1st. or 2nd. party encrypted? The Server administration is entirely shielded from the US DOJ or other goose stepping agencys screaming that the cloud server staff 'knew' those files were of copyright material. In house server encryption would allow the US DOJ or some other Western agency to imply and charge that the server staff and administration could decrypt the files themselves or obtain unencrypted copies to check if they were of copyright material prior to accepting them or not deleting them. A 2rd. party separate online encryption site with multiple encryption algorithms entirely bypasses that policing agency charge or allegation. A 1st. party (the original uploader of the file) could independently chose to encrypt the file themselves (in-house) prior to uploading. A relatively small PHP script would be included on the cloud server to make certain all the files uploaded were in fact encrypted and reject with a msg. encrypted only files should anyone try to send unencrypted files to be stored.

B) Why would/should all the files be stored as encrypted? This allows the Server administration to have entire plausable deniability in regards to the files they are storing. The burden is entirely placed on the users complying with the legal form they signed/approved as a user or member of that cloud server site.

3) All physical public cloud servers should be located outside of the United States. Sweden,Hong Kong, Russia, Sweden have appeared to not join into the US feeding frenzy of becoming the global policeman of the Internet. There are undoubtedly others, however cloud servers and their American customers physically located in the United States should be painfully aware that it is becoming rather routine for the US Dept. of Justice to twist existing laws to suit it's own rather dark purposes. If you or associates use cloud storage servers physically located in the United States, they should encrypt their files prior to uploading them. Although that doesn't guarantee everyone using that server does that and therefore that service could also suddenly disappear along with all of your vital files you placed on that cloud storage facility.

4) Do not accept US dollars (US currency) as a member/subscriber payment. Instead for file sharing services which accept payments, insist they are in a non-USA domination. For file sharing services which accept payments thru a 3rd. party payment center, use only non-USA based/located payment providers with the payments sent to the file sharing business in non-US dollars.
The far reaching US DOJ twisting of existing US Laws include any foreign website accepting US dollars OR utilising a US based (physically located in America) payment service such as paypal is being construed as including that foreign business as being held to hidden, nefarious and often far reaching US Internet laws!
5) Anonymous transfers and/or the cloud servers do not keep any IP target lists. This provides yet another Onion Barrier being that of Anonymous transfers which again removes the burden of the server administration being threatened, extorted or dragged into court by the FBI or NSA agents to produce the IP address's of the file downloaders. US DOJ is pushing US and Western IP providers to keep lengthy detailed records of the IP addresses of their customers,clients. Such a step as 5) would require either that server be located in a nation outside of such US DOJ affiliation or thru a series of Anonymous relaying peers. It is entirely likely if a single server were used and located in a cloud server embracing nation such as Sweden the US DOJ would likely go after them via Germany's High Courts, however such a server location could shred any and all IP addresses daily until European Courts ordered them to do otherwise. Multiple Anonymous relay foreign peers however would likely be the best choice.
You should realise FBI,NSA agents have demanded such IP users/client extended lists nearly routinely now, not only from USA IP providers,but also from foreign nations IP providers, DNS server staff, Search Engine CEO's etc. It is also routine for those US Agents to make very serious threats if their wide-open demands are not successful and very, very few CEO's much less corporate managers refuse such demands after those threats have been uttered to them.
The US Dept.of Justice raid on the MegaUpload suspects went after seizing their homes, cars, bank accounts as well as 50 million dollars worth of IT equipment, servers, 18 domains nearly all of which were overseas with the exception of a server located physically in the State of Virginia which imo was MegaUploads undoing. The point apparently was the US DOJ wanted to seriously punish and set a scape goat example to the entire world regarding cloud servers. Pushing for a 50 year federal prison term charge on the MegaUpload web designer is way over the top for even the most depraved East German styled police actions. Such could be seen as a long drawn out death sentence for that web designer if convicted, as he would be forced to spend at least 80% of that 50 years in a federal prison if convicted.

When the U.S. Department of Justice working in conjunction with New Zealand’s law enforcement agencies took down the popular file-storage and sharing site Megaupload and arrested its executives, they never counted on the Internet-based hacker and protest group, Anonymous, attacking the Department of Justice (DoJ), Recording Industry Association of America (RIAA), Motion Picture Association of America (MPAA), Universal Music, and other Websites. And, they certainly didn’t expect for many of these sites to be taken down by this assault.

I don't think the people who ran Megaupload should be regarded as martyrs or heroes, they were making a fortune from other people's work, charging gullible idiots for the privilege of breaking the law and finally pushed their luck too far.

Ironjade, in no fashion did I think nor portray the MegaUpload staff and employees as heros, perhaps as victims. However first and foremost in posting my concerns about this travesty of US Justice is the enormous impact it will have on foreign based Internet business's and American citizens.

Few realize that MegaUpload had previously filed numerous court filings against online pirates, created in-house an abuse security tool which outside Music,Movie connected business's could and did use to remove as many as 5,000 linked files a DAY if those business's chose to do so. MegaUpload filed legal briefs with it's payment provider (paypal) outlining those business's MegaUpload viewed as promoting or conducting illegal file sharing. Such commendable efforts however apparently were not enough and as I have repeatedly noted previously, having some of it's file servers physically located in Virginia, USA was a big mistake in opening themselves up to the very heavy handed US DOJ global police actions.

What is the new standard of US Judicial Justice Dept.? Where a MegaUpload website designer is charged with federal felonys which could result in a 50 year federal prison term while giving the appearance that Goldman Sachs can steal 750 Billion without a single charge against them? Such US goose stepping judicial actions strongly suggest the US legal system has been bought by rich interests and now serve only the rich.

Going after Megaupload, one of the most popular sites in the world and one that uses a surprising amount of corporate bandwidth, might seem a strange choice. (As an example of its scale, Megaupload controlled 525 servers in Virginia alone and had another 630 in the Netherlands—and many more around the world.) For years, the site has claimed to take down unauthorized content when notified by rightsholders. It has registered a DMCA agent with the US government. It has created an “abuse tool” and given rightsholders access. It has negotiated with companies like Universal Music Group about licensing content. And CEO Kim Dotcom sent this curious e-mail to PayPal in late 2011:

Our legal team in the US is currently preparing to sue some of our competitors and expose their criminal activity. We like to give you a heads up and advice [sic] you not to work with sites that are known to pay up loaders for pirated content. They are damaging the image and the existence of the file hosting industry (see what's happening with the Protect IP Act). Look at Fileserve.com, Videobb.com, Filesonic.com, Wupload.com, Uploadstation.com. These sites pay everyone (no matter if the files are pirated or not) and have NO repeat infringer policy. And they are using PayPal to pay infringers.

But the government asserts that Megaupload merely wanted the veneer of legitimacy, while its employees knew full well that the site's main use was to distribute infringing content. Indeed, the government points to numerous internal e-mails and chat logs from employees showing that they were aware of copyrighted material on the site and even shared it with each other. Because of this, the government says that the site does not qualify for a “safe harbor” of the kind that protected YouTube from Viacom's $1 billion lawsuit.

Megaupload purposely did business in the US and with US residents, and it targeted its sites (in part) toward the US. You generally can't gain the benefits of doing business in a jurisdiction without complying with its laws, and being subject to its enforcement efforts (assuming that the jurisdiction can physically gets its hands on you).

The indictment makes these points repeatedly. Megaupload wasn't just some Hong Kong enterprise that "happened" to be used by US residents. The site had leased more than 1,000 servers in North America alone; 525 were at Carpathia Hosting and were located in Virginia. Between 2007 and 2010, Carpathia received $13 million from Megaupload. (Cogent Communications in the US supplied a few additional US servers and bandwidth.)

The money was mainly routed through US-based PayPal, which is how Megaupload collected subscriptions from users looking for premium accounts. This wasn't chump change; the government claims that the Megaupload PayPal account has "received in excess of $110,000,000 from subscribers and other persons associated with Mega Conspiracy."

Megaupload also made money through ads, using services like Google's AdSense (until 2007) and the AdBrite network. Both are based in the US. AdBrite alone paid at least $840,000 to Megaupload. Payments were made to top uploaders, including those who lived in Virginia.

I agree that the US is turning into even more of a bully than usual lately but they do seem to pick their battles very carefully. I can't see them taking on YouTube, Google etc. who do much the same thing as Megaupload, albeit for free. However, if I were in charge of Rapidshare I'd be a worried man.
I have nothing against [illegal] file sharing per se but the [those] who profit from it deserve all they get.

Kim DotCom has implemented Four of my Five suggestions that I made in this post for his new Mega end-end encrypted filesharing service whose pre-launch has been so globally popular, new registrations have been 100,000 per hour. [8]

I hope future filesharing services will also follow my 5 suggestions clearly stated in the beginning of this threaded posts to further isolate themselves from jackbooted judical agencys intent on Internet Censorship and questionable legal authority behind such raids, seizures and theft of cash assets designed to prevent defendants from mounting an adequate defense team to throw out the illegal actions.

I presume that by using the term "Goosestepping Feds" you mean" Overzealous law enforcement"?
To compare modern civilized Governmemt officials with the N-a-z-i-s is a bit "overzealous" on your part.

Watch a few more of the WWII programs on Discovery Channel etc. and rethink.
Your comparison leaves me wondering about your state of mind and general morality.

The USA Gov. recently surpassed the infamous maximum number of prisoners all time historical record set by Germany during World War 2.

The USA Gov. recently passed the NDAA law whereby the long standing US Bill of Rights is largely destroyed, the Right to be charged before arrest Gone, Right to a attorney Gone, Right to a trial Gone, and held without charges indefinitely. [1][2][3][4]

The new USA Gov. NSA Database passed the East German Stasi all time record for collecting information on each of it's citizens to be used against them or for blackmail purposes if needed. All emails, phone calls, texts recorded and scanned. CCTV's globally now feed into extremely fast biometrics facial software and store your movements thru most modern malls across America and globally. [13][14][15]

A full 80% of warrant-less demands for Social Media users personal information come from the United States. Nations like China and Russia account for the smallest fraction.

I would term SWAT teams and members 'overzealous' in carrying out their door busting raids while waving machine-guns at the onlookers then parading around with armored vehicles and attack dogs like some mentally ill trophy hunters.

I would term USA federal agents who knowingly charge Megaupload website editors and designers with 15-20yr prison sentence simply for helping design it's webpages, 'Goose Stepping Agents' that are in my opinion entirely corrupted and operate without any ethics nor actual International sense of Justice. Yet such far over reaching charges and actions which shocked the New Zealand Judges by their inherent illegality and over reaching scope are becoming the norms for squeezing the life out of American citizens.

When any so-called law enforcement travels down the road of utter depravity and injustice, the entire system of Justice becomes corrupted. If that nations citizens and global community allows that to continue, that corruption spreads to neighbouring nations whose citizens also fall victim to Governmental abuse, harassment, injustice, threats and blackmail.

The previous goose stepping regimes of the German Brownshirts whose right wing nationalist extremist movement is a near parallel to the extremists found in USA Republican leaders today. After World War 2 the Brown Shirts were replaced by the East German Stasi who spied on its own people, shredding their privacys, freedoms and libertys is a near parallel to the NSA and the illegal alliance of the NYPD and LAPD working directly with the CIA against USA Citizens inside America today. After the Stasi the goose stepping actions by the 1960-1980's Soviet KGB was then notorious for the utter destruction of citizens human rights. Now USA's Patriot Act, Operation Perfect Citizen and NDAA laws have surpassed even that former historic goose stepping agency and their extremist actions by destroying many rights upheld and once lawfully guaranteed under the US Bill of Rights which many Americans had previously perished in protecting.

Given this journey down goose stepping history, perhaps you could rethink the actions of the goose stepping federal agents that seized Kim Dotcoms homes, vehicles, cash and millions of dollars of IT equipment under the mere guise of 'copyright infringement' as not simply overzealous, but rather goose stepping insanity, a symptom of injustice which was immediately seen as unethical by the New Zealand Judges. Kim Dotcom apparently was intelligent enough to have hidden millions in cash for his defense team of attorneys which the goose stepping USA federal agents were not able to locate and seize in their crass, gross attempt to deprive Kim Dotcom of any and all means to defend himself from the grossly inflated and unjust charges. Depriving a USA citizen the ability to mount an adequate defense against a mass of trumped up federal charges are now in my opinion the routine action and agenda by the USA Department of Justice using ATF, DEA, IRS, FBI agents.

The New Zealand Judges were not going along with the mass abuse of search and seizure laws in New Zealand over a USA claim of 'copyright infringement' to extradite Kim Dotcom which New Zealand rightly had no such extradition law over mere copyright infringement. The USA Department of Injustice thereafter added the charge of 'racketeering' and conspiracy which New Zealand has extradition laws for. However in the moronic attempt by the USA Dept. of Injustice to double down by piling more unprovable, idiotic charges on top of the others, the legal standard required to prove racketeering and conspiracy in New Zealand is very high and likely not even remotely achievable by the goose stepping USA federal agents in New Zealand trying to gain the extradition order to ship Kim Dotcom back to a trial in a 'you are guilty' Virginia Courtroom.

While New Zealand jurists are laughing at how abusive, moronic and injust the actions are by the USA federal agents in the MegaUpload Case in New Zealand, USA Citizens would have been found guilty by the racketeering and conspiracy charges in a Virginia Courtroom, not because they committed those crimes but because in my opinion the US Dept. of Injustice would order/tell the Virginia Jurists and Judges to find them GUILTY. Now proceeding the MegaUpload case by USA Presidential Executive Order, Powers in the NDAA Law stipulate the US Gov. can seize anything you own,land,food,buildings,assets w/o charges of wrongdoing. Does that remotely sound 'Civilised' or 'The Land of the Free'?

USA vs Kim Dotcom extradition update:

Kim has won two lower New Zealand Court rulings however USA agents with near unlimited funding have won a court appeal which Kim Dotcom's defense team is now appealing.

1) The Dotcom defense team pointed out the surveillance was illegal which even the NZ Prime Minister is aware of that.
2) The Dotcom defense team pointed out the warrant issued by the USA agents prior to 70 USA agents raiding Kim Dotcom's site, home was illegal and hence invalid.
3) The New Zealand Court system had no extradition law regarding infringement of copyrights, USA agents then added the much more complex charge of RICCO which is normally only used on Mafian organized criminal enterprises and conspiracys to force a Kim Dotcom extradition from New Zealand.

The newest NZ court finding overturned a earlier ruling forcing the USA Government to grant Dotcom access to key evidence against him before his extradition hearing in August. USA has no evidence to support its illegal surveillance nor to support its illegal warrants and apparently figures to try every dirty trick to avoid being forced in a NZ court to admit to that.

The latest NZ court ruled that such an expansive disclosure of evidence would slow down the legal process, and a mere summary of the US case would suffice for Dotcom. Such appears to be entirely void of legal standing and judicial laws. The Kim Dotcom team has repeatedly shown the very basis of the warrant against him was illegal, the USA surveillance also was illegal. A 'mere' summary of the US case would simply gloss over those 'legal needs' and once Kim Dotcom is extradited to a Virginia State Courthouse, he'd be guilty the moment his plane touched down by a utterly bought and paid USA Judicial System, sentenced to a lengthy federal prison sentence and crushed with a huge monetary fine.

Kim Dotcom and his defense team MUST keep their heads on the ball, there is no New Zealand law extraditing anyone for a foreign governments copyright infringement case, it is the much more difficult to prove RICCO crime that Kim Dotcom would be extradited for. As such Kim Dotcom's defense team must force USA Gov. agents to prove they have enough evidence against Kim Dotcom to even remotely establish that charge against him. RICCO statues hold a very high level of jurisprudence to prevent a corrupt judicial system from slapping citizens with that willy nilly without a huge amount of supportive evidence against them.

While Kim Dotcom's extradition hearing is scheduled for August, it is likely further postponements and delays will push that farther into the current year. Meanwhile Kim Dotcom has sent out a global defense pro-bono attorney's request and receiving offers of help from many teams of attorneys around the world.

Last month, the New Zealand Judge ruled that the warrant the USA agents was invalid and the removal of evidence by the USA agents was illegal. The same judge went on to state that USA was the 'enemy' regarding its goose stepping approach to copyright laws and attempts to railroad Kim Dotcom.
