(SOLVED) HP Tablet, "Battery power low", NOT !!!

I have installed Linux Mint 20.1 with the Mate UI on a HP Elite x2 1012 G1 tablet running windows with a Intel Core M3-6Y30 CPU, 4 GBytes of Ram, Samsung 128 GByte Solid State Drive and a new battery.

PROBLEM:
I keep getting alerts that the "Battery power is low".
This is with a fully charged, NEW battery regardless if it is plugged into AC or not.
The Battery app from the tool bar report 100% charge with 7.7 hours remaining.
The battery Alert msg says 6%.

Same problems with UBuntu and with Cinnamon but the Cinnamon Battery power app had a bit more info.

It is NOT the laptop Battery that is low ...
it is the tiny "AAAA" battery in the HP/Watcom pen :D :D :D :D :D :D
