Update kernel via terminal gives "Could not locate dkms.conf"

I am running the command to update Mint through the terminal which is:
sudo apt-get update && sudo apt-get dist-upgrade -y.
However, when I run it I get this error at the end and I don't know why. Any help would be massively appreciated. Thank you.

It seems to be an issue with a virtualbox install, do you use virtualbox?

That folder name uses a standard dkms format and is a version newer than what is available through the software channels for LM18

Yes but only since today and I'm running Kali Linux on it only.

Where did the virtualbox install come from? I would guess the virtualbox website

I think renaming the folder may eliminate the error with new kernel installs

Tiime to try another command, the output may be long so we will dump it into a text file
