Stolen Logo?

Post by Chris_C »

Not an attorney but Lawmachine.com has a very similar logo to Mint. Any attorney's out there that know if this falls under violations of intellectual property?

They do not look even close to each other other then the color of green used.

Print and art, isn't even close.

Stuff like this is about customer confusion, people looking for legal advice are not going to confuse it with a software project specializing in various editions of operating systems and vice versa. Although Clem could pay the "either be our free legal retainer when we need you, or we sue you over the logo" card

There was a very similar lawsuit in the news lately regarding Sony Ericsson and Clearwire, in which case the logo was less similar. I dont remember the outcome of it though: http://www.nwinnovation.com/story/0033279.html

Looks a bit similar but from experience when I owned a t shirt transfer manufacturer company, if one of my designs sold great about 5 other garage companies and bigger ones made clones of it in a week and flooded the market.
Unless I had a lot of money going to court would cost me too much to make it worth my while.
And it has to be extremely close if not the same to win it, any little changes can loose the case easily.
In other words it ain't worth it in most cases which is why bootlegging is a huge business, it drives manufacturers nuts and the only ones I ever seen do raids was huge corps that had lawyers in their back pockets all time, the little man rarely stands a chance, at least in canada.

I hear you on that one, makes everyone scared to do anything. I just came up with new designs and got mine out before they got cloned, it was just part of the game.
I feel sorry for a lot of companies. The one I couldn't believe was macdonald's getting sued because there coffee was to hot  , now everyone gets cold coffee because of it  Not that I drink it (I drink timmies instead).
